A professional footballer who allegedly raped a sleeping woman in Liverpool admitted that when they had sex he couldn’t see if her eyes were open.
Sancidinu Da Silva, 20, had only been staying in Merseyside for three or four days last summer ahead of a try-out with Scottish giants Celtic.
The Portuguese-speaking player is accused of raping a 24-year-old woman, before getting down on his hands and knees and begging for her forgiveness.
Liverpool Crown Court heard the woman went out with a friend in Liverpool on June 19 and spent the night drinking and “taking a little cocaine”.
Sarah Holt, prosecuting, said they left Tiki Joe’s in Slater Street and were waiting for a taxi at around 4am, when the woman recognised a promoter called Chris Banner.
She agreed to go back to his flat in Henry Street for a house party, but her friend left in a taxi.
There were two other men with him, who she described as black men – one tall and one short.
She said she was drunk and could not remember how they walked to the Printworks Apartments.
Miss Holt said in the flat the woman began kissing Mr Banner, which was “entirely consensual” before they went into a bedroom for a time. She later said she was “very tired” and wanted to sleep.
Miss Holt said: “The next thing she knew she woke up to find a black man on top of her having sexual intercourse with her. The Crown say this male was the defendant.
“She tried to push him off. She asked for Chris, but the man told her ‘it’s okay, I’m Chris’. She knew she was drunk, but she also knew she wasn’t so drunk that she confused this male with Chris.”
The woman then put her clothes on and shouted for Mr Banner.
Miss Holt said: “She was very upset and crying. She was also shouting. She left the bedroom and confronted the male who had sex with her. He didn’t speak English.”
Miss Holt said that Da Silva, who was helped in court by a Portuguese interpreter, then “repeatedly said sorry”.
The woman left the flat but he followed her outside onto the street.
Miss Holt said: “He kept shouting sorry and at one point got down on his hands and knees in front of her, again repeating that he was sorry.
“She slapped him in the face. This caused one of his earrings to fall out. She then ran off down the street to get help.”
A passerby called police who went to the apartment and viewed CCTV footage before spotting Da Silva and arresting him.
Miss Holt said: “He said that when Chris came out (of the bedroom) Chris told him the female had performed oral sex on him, and, according to the defendant, Chris then asked him if he wanted to have sex with the girl. The defendant said he would.”
He told officers that he had sex with her but didn’t understand why the woman was shouting.
Miss Holt said: “He accepted he apologised to her. He said he did this because his friends told him to.
“The defendant said that at no time did he speak to the female and never did she speak to him. He said she must have been awake because it was only five minutes between the other man leaving the bedroom. He admitted he couldn’t see whether her eyes were open or closed.
“He admitted initially she didn’t move but at one stage put her arms around his back, as if to hug him, and that at one stage she moved her leg.
“He thought the reason for her distress was that she had not liked the sexual intercourse.”
Miss Holt said it was for the jury to decide whether Da Silva took advantage of a drunk, young girl who had fallen asleep, and whether he did so “knowing full well she hadn’t given her consent”.
Da Silva, who gave his address as Vandyke Street, Toxteth, denies rape.
